“The court’s disagreement on this issue evidences the degree of uncertainty regarding the extent of the BOM’s regulatory authority under the current statutory scheme. Clarification as to the scope of the regulatory authority of the BOM in this arena implicates public policy determinations that are better left to the legislature.” At this point the court has concluded that this subject needs to be fixed by the legislature and not this court.
